Terms of Service
These Terms of Service (the “Terms”) govern your access to and use of Podzone, a podcast monitoring, transcription and search service (“Podzone”, “we”, “us”). By creating an account or using the service you agree to these Terms. If you do not agree to them, do not use the service.
1. The service
Podzone ingests publicly published podcast feeds, transcribes the episodes they reference, and makes the resulting transcripts searchable. Customers can define keyword rules and be notified when an episode matches one, search across the transcribed catalogue, and access both through an API.
Transcription is automated. The service is provided on an “as available” basis, and we do not guarantee that any particular podcast, episode or feed is covered, that any transcript is accurate, or that any alert is delivered within a particular time. Coverage figures and alert latencies described on our website are targets, not commitments. See section 10.
2. Accounts
You must provide accurate registration details and keep them current. Sign-in is by a single-use link sent to your email address, so access to your account follows access to your inbox: keeping that secure is your responsibility. You are responsible for all activity under your account, for keeping your sign-in links and API keys confidential, and for notifying us promptly at [email protected] if you believe your account has been accessed without your authorisation.
Accounts are for a single named person. Credentials must not be shared between people; where your plan supports multiple seats, each person needs their own. You must be at least 18 years old to use the service.
3. Your licence to use the service
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to access the service and use the data it returns for your own internal business purposes.
If you are an agency or consultancy, you may use the service on behalf of your clients and include results in the deliverables you produce for them, provided your clients do not receive direct access to the service and are bound by restrictions at least as protective as these Terms.
4. Acceptable use
You may not:
- resell, sublicense, republish or redistribute transcripts, search results or catalogue data, in bulk or systematically, to anyone outside your organisation;
- use the service, or data obtained from it, to build or train a competing podcast search, monitoring or transcript product, or to build a derivative database for distribution;
- use the data to train machine learning models, other than transient, internal analysis of results you are entitled to (for example summarising or classifying your own matches);
- scrape the service, circumvent rate limits or quotas, or access it other than through the interfaces we provide;
- share, resell or rotate credentials to exceed the limits of your plan, or create accounts in bulk;
- attempt to gain unauthorised access to the service, other customers' data or the systems behind it, or probe, scan or test their security;
- reverse engineer or attempt to derive the source code of the service, except where that restriction is unenforceable by law;
- use the service unlawfully, to infringe anyone's rights, or to harass, defame or surveil a private individual;
- transmit malware, or place an unreasonable load on our infrastructure.
We may investigate suspected breaches and may suspend access while we do so.
5. Your data
You keep ownership of what you put into the service — your alert rules and anything else you submit. You grant us a non-exclusive, worldwide, royalty-free licence to host, store and process it for the purpose of operating the service for you.
We do not sell your data, and we do not use your alert rules to train models offered to other customers. We may use aggregated, anonymised statistics about how the service is used — in a form that cannot identify you or your organisation — to operate and improve it. How we handle personal data is described in our Privacy Policy, which forms part of these Terms.
6. API
API access is subject to the quotas and rate limits of your plan. We enforce these automatically and may throttle or reject requests that exceed them. We may change limits, deprecate endpoints or require migration to a new version, and will give reasonable notice of breaking changes where we can.
Data obtained through the API is subject to the same restrictions as data obtained through the web interface, in particular those in section 4. You are responsible for everything done with your API keys.
7. Podcast content and publishers
Podcasts indexed by Podzone are published by third parties. We do not own them, and nothing in the service grants you any rights in the underlying works. Rights in each episode remain with its publisher and rights holders.
We do not host or serve podcast audio. We retrieve audio in order to transcribe it, and our references to an episode link to the publisher's own source. Transcripts are machine-generated text derived from publicly published audio, and we make them searchable so that mentions can be found and cited.
We crawl politely. Podzone identifies itself in its User-Agent with a contact URL, honours conditional requests so unchanged feeds are not re-fetched, backs off when a host signals that it is overloaded, and stops polling feeds that are withdrawn.
If you are a publisher or rights holder and want your content excluded, or believe something on Podzone infringes your copyright, contact [email protected]. We remove material where required and terminate the accounts of repeat infringers.
8. Our intellectual property
The service — the software, the interface, the search index and the compiled catalogue — belongs to us and our licensors. These Terms grant you a licence to use it, not any ownership of it. You may not use our name or logo without our written permission. If you send us feedback or suggestions, we may use them without obligation to you.
9. Fees and payment
Paid plans are billed in advance and renew automatically for successive periods unless cancelled before the renewal date. You authorise us, or our payment processor, to charge your payment method for fees when due, and you agree to keep your billing details current. We may suspend access for non-payment after giving you reasonable notice.
Cancellation takes effect at the end of the current billing period. Fees already paid are not refunded on a prorated basis, and are otherwise refundable only as set out in our Refund Policy. We may change our prices, with at least 30 days' notice before the change applies to your renewal; if you do not accept a change, your remedy is to cancel before it takes effect. Fees exclude taxes, which are your responsibility.
10. Disclaimers
The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows.
In particular, transcripts are produced by automated speech recognition and will contain errors. Keyword matches may be missed, and matches that are reported may be wrong. Coverage of the podcast catalogue is incomplete and changes over time, and alert delivery may be delayed or fail. You should verify anything material before relying on it, and you use the service's output at your own risk.
11. Limitation of liability
To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, goodwill or business interruption, however caused, even if advised that they were possible.
Our total aggregate liability arising out of or relating to these Terms or the service will not exceed the greater of the fees you paid us in the twelve months before the event giving rise to the claim.
These limits do not apply to liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, or for fraud or wilful misconduct
12. Indemnification
You will defend, indemnify and hold us harmless against third-party claims, damages, losses and reasonable costs (including legal fees) arising from your use of the service, your breach of these Terms, your infringement of anyone's rights, or your use or redistribution of data obtained from the service.
13. Suspension and termination
You may stop using the service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if your account is used unlawfully, for non-payment, or if we are required to by law. We may also discontinue the service, in which case we will give reasonable notice where it is practical to do so.
On termination, your licence to use the service and to use data obtained from it ends, and you must stop using that data and delete copies you still hold, other than results already incorporated into work product delivered before termination. We may delete your account data after termination; retention periods are described in the Privacy Policy. Sections 4, 5, 7, 8, 10, 11, 12 survive termination.
14. Changes to these Terms
We may update these Terms. When we make a material change, we will, if you have an account, notify you before it takes effect. Continuing to use the service after a change takes effect means you accept the revised Terms.
15. General
These Terms, together with the Privacy Policy, are the entire agreement between us about the service. If any provision is held unenforceable, the rest remain in force. Our not enforcing a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for failure to perform due to events beyond its reasonable control. Nothing here creates a partnership, agency or employment relationship.
